Document Acceptance Policy & Recording Requirements

  • Documents presented for recording must be originals, signed and properly dated and notarized.
  • The document must be of sufficient legibility to produce a clear reproduction. Font style should be easy to read. The minimum font size we will accept is 8 point. We prefer larger.
  • Signatures: All signatures shall be capable of legible reproduction and shall have the corresponding name typed, printed or stamped underneath the signature. If the name or names of any signer or notary public are not plainly typed, printed or stamped underneath the signatures, the Register of Deeds shall charge and collect a fee of $1 in addition to all other fees provided in the schedule (K.S.A. 28-115)
  • For documents pertaining to land records, a complete legal description is required. This can be part of the document or as an attachment or exhibit. DO not USE THE ABBREVIATED LEGAL DESCRIPTION FROM THE COUNTY WEB SITE OR TAX STATEMENTS.
  • Margins: effective January 1, 2015, documents should have a 3" top margin on the 1st page. This whole area should be blank, no return addresses, etc. If not, a cover sheet will be added in accordance with K.S.A. 28-115 (e). Side and bottom margins should be 1." Top margins on following pages should be 1."
  • The correct fees must be submitted with the document.
  • A sales validation questionnaire is required to accompany all deeds, affidavits of equitable interest and contracts UNLESS the document meets one of the exemptions. This must be stated on the document. (Pursuant to K.S.A. 79-1437 a Real Estate Validation Questionnaire is not required due to Exemption No.________________.) The appropriate exemption number must be shown. We accept the one part forms.
  • Re-recording Documents: We will accept the original, corrected document for re-recording with new signatures of the original signers and a new notary acknowledgement for them. Recording fees are based on the total number of pages
  • Mortgage Assignments and Releases: The document should refer to the original mortgage, stating names, legal description and the Book and Page. Assignments are required to also have the complete address of the assignee (K.S.A. 58-2319)
  • On Oil and Gas Assignments and Releases, the document should refer to the recording date of the original lease.
